TERMS AND CONDITIONS OF SALE

1. General

The general terms and conditions of sale described below apply to all products and services sold exclusively through the Cocooning Nature SA E-Commerce site. They define the rights and obligations of the parties.
Cocooning Nature SA reserves the right to modify the content and form of these general terms and conditions of sale at any time.

2. Products

The products visible on the E-commerce site and the real-time stock status of the product displayed on the site are for informational purposes only and do not constitute offers from Cocooning Nature SA.

Cocooning Nature SA undertakes to make the necessary efforts to ensure that the photographic representation of the products and services offered for sale on the E-Commerce site is as faithful as possible to reality. However, given the way these products are presented on the Internet, it is possible that the customer's perception of the photographic representation of the products may not correspond exactly to the products themselves. 

3. Personal data

Cocooning Nature SA undertakes to respect the confidentiality of personal data communicated by customers on the E-Commerce site and to process them according to legal obligations.

Cocooning Nature transmits personal data to third parties only insofar as it is essential for the proper execution of the Order.

No data will be transmitted to third parties for commercial purposes.

Customer data may be used by Cocooning Nature SA's internal services:

-        For order processing, deliveries and invoicing 

-        To get your feedback to improve our products and services

The customer has the option of refusing to receive invitation or commercial communication emails from Cocooning Nature SA when they first register. This feature can be modified at any time by unsubscribing from the newsletter.

The customer undertakes to provide the personal information necessary for the management of their order (delivery and invoicing). This information must be correct, valid and up-to-date. Information relating to their identification and password must be kept secret by the customer.

4. Sales process

4.1. Orders

Once the desired product is selected, it is placed in the "shopping cart" by clicking the "Add to cart" button. The customer can then continue their selection of items, modify their shopping cart or continue the order process and pay.
The validation of the order by the customer constitutes acceptance of the general terms and conditions of sale.
Once the order has been validated and paid for, the customer receives an order confirmation email.

4.2. Prices

The prices indicated per article on the E-Commerce site are inclusive of all taxes and exclude preparation or logistical shipping costs. Shipping costs for the order will be indicated before the final validation of the order.
Cocooning Nature SA  reserves the right to modify the prices and other fees displayed on the E-Commerce site without prior notice and at any time. However, products will be invoiced to the customer based on the rates in force at the time of order validation.

4.3. Product representation

Cocooning Nature SA undertakes to make the necessary efforts to ensure that the photographic representation of the products and services offered for sale on the E-Commerce site is as faithful as possible to reality. However, given the way these products are presented on the Internet, it is possible that the customer's perception of the photographic representation of the products may not correspond exactly to the products themselves.

4.4. Secure payments

For payment of the order, the following are accepted:

- Visa
- Mastercard
- Postfinance
- Cembrapay

Payment for purchases is made on the secure bank or postal servers of Cocooning Nature SA's partners, as mentioned above. This implies that no banking or postal information concerning the Customer transits via Cocooning Nature SA's sites. Payment by bank or postal card is therefore perfectly secure.

The order will be registered and validated as soon as payment is accepted by the payment system chosen by the Customer. Their Order will be validated and their card debited automatically at the time the Order is registered.

The Customer must imperatively complete the registration form provided on the Website before being able to validate an order. The details of the Customer's credit card or Postcard are encrypted using the SSL (Secure Socket Layer) protocol and are never transmitted unencrypted over the network. The advance payment is made directly to the bank or the Post Office. The card number is not sent to Cocooning Nature SA.

The invoice payment option (including installment payment) is managed by CembraPay SA. The general terms and conditions and the privacy policy of CembraPay SA apply.

Screening: In order to check if we can offer you the CembraPay payment option, we (data controller) transmit your personal data (name, address, date of birth, contact details (e-mail, phone number) as well as IP address, proxy server used, etc.) to CembraPay (data processor). CembraPay processes your data exclusively for the purpose of carrying out the creditworthiness check.

The minimum order on the website is CHF 25.- incl. VAT, excluding shipping costs. 

4.6. Delivery

Shipping costs are calculated at the end of the order, according to the weight, volume and rates of the carrier in charge of shipping. They are at the customer's expense if the amount of the products chosen in the order is less than CHF 89.- in Switzerland, and will therefore be invoiced CHF 7.90 for Switzerland.

Cocooning Nature SA ensures the shipment of goods sold through the E-Commerce site in Switzerland. Products and/or services will be sent to the delivery address indicated by the customer during the order process.

From the order and payment confirmation, delivery times, given as an indication, are as follows:

-        3 to 5 working days for Switzerland

In case of temporary stockout, Cocooning Nature SA undertakes to deliver the missing item as soon as possible or to propose a replacement solution.

 

4.8. Returns, withdrawal and refund

Upon receipt of the product by the customer, the customer has a right of withdrawal, i.e. a period of 14 days to return the delivered product, with the return costs being at their expense. Only products purchased through the E-Commerce site, and returned with their protective film or individual packaging intact (unopened and in their original packaging) may be refunded.

The procedure to follow is as follows:

- The customer sends an email to nature@cocooning.ch to make a return request

- The customer returns their merchandise at their own expense to the following address:

Switzerland

The product must be complete, properly protected, in its original packaging, with the film or individual protective packaging intact (unopened), and accompanied by all possible accessories.

The product must be accompanied by:

- The order number

- The name of the person returning the order

The product is checked by Cocooning Nature's internal services, who will validate or not validate the refund, particularly by verifying that the product has been returned complete and in a condition suitable for resale, as required by the right of withdrawal.

If the merchandise meets the return requirements, it may be refunded or exchanged.

If the merchandise does not meet the return requirements, it will be returned to the customer, who will not be able to obtain a refund.

 

5. Applicable law

These general terms and conditions of sale, as well as any sale to which they apply, are governed by Swiss law. Any dispute arising from or in connection with these general terms and conditions of sale or any sale to which they apply shall be settled in accordance with Swiss law, whether such dispute is contractual or tortious in nature, or based on another clause. The application of the 1980 United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. The exclusive place of jurisdiction is Lausanne.

6. Original text

The general terms and conditions of Cocooning Nature SA are written in French and German. In case of contradiction, the French version shall prevail.
